REGINA THOMPSON DESIGN - TERMS AND CONDITIONS
'Regina Thompson Design' is acknowledged as 'RTD' and 'Customer' is acknowledged as 'Client'. The term 'Project' refers to any requested task or tasks to be performed and completed by RTD. All services provided by Regina Thompson Design to the Client are subject to the following terms and conditions:
Acceptance:
Agreeing to conduct work with Regina Thompson Design indicates agreement to and acceptance of these Terms and Conditions.
Fees and Payment:
Regina Thompson Design shall discuss with Client any and all preferences for a project and the requested time frame for project completion, and any other information which will effect final cost. RTD carefully considers the available budget and bases fees on an hourly rate for designers and an estimation of the time required to achieve the agreed outcome. Before starting work, RTD will present Client with a proposal, seek Client's feedback and await Client's approval. At RTD's discretion, a deposit may be required before work begins. Client is responsible for all time expended and incurred by RTD under this agreement. Client is also responsible for all out of pocket expenses incurred by RTD, and RTD may, at its sole option, require Client to advance the out of pocket expenses or to pay them directly to the providers. All graphic/printing services are non-refundable.
Regina Thompson Design will not release completed artwork until invoice is paid in full.
Complete quotations will be provided on request, and are valid for 30 days from the date of issue.
All invoiced charges are to be paid in U.S. dollars and are to be made payable to Regina Thompson Design.
Checks returned for insufficient funds are assessed a return charge of $25 and the account is immediately considered to be in default until full payment is received. Clients with accounts in default agree to pay RTD reasonable expenses, including attorney fees and costs for collection by third-party agencies, incurred by RTD in enforcing these Terms and Conditions.
Regina Thompson Design reserves the right to adjust any price given within a quotation where the demands of the Client have exceeded the initial agreement. Client will be notified if actual cost will exceed the original quoted amount.
Payments are due on receipt.
A late charge of 1% per 30 days will be applied to any invoice past due. If payment cannot be made before due date, Client may contact RTD to negotiate other possible arrangements.
Termination of Project:
Termination of a project may be requested by the Client via email, telephone or written request. The Client will be required to pay for all charges incurred on the project prior to the termination date
Copyright and Trademarks:
The Client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Regina Thompson Design for inclusion in any design project are owned by the Client, or that the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect and defend Regina Thompson Design from any claim or suit arising from the use of such elements furnished by the Client.
General:
Regina Thompson Design shall guarantee confidentiality to the Client regarding any information passed as part of the design process. Regina Thompson Design reserves the right to retain and publish any non-confidential designs as part of our portfolio or promotional campaigns.
Regina Thompson Design reserves the right to change, at any time without notification, the terms and conditions.
Agreeing to conduct work with Regina Thompson Design indicates client has read and understood the Terms and Conditions for service provided by Regina Thompson Design and agree to fully abide by them without exception.
